Touch ‘n Go eWallet Games Hub

Terma & Syarat

Introduction
1. “Games Hub” is a gamification feature on the Touch ‘n Go eWallet (“TNG eWallet”), which allows users to participate and play various skill-based mobile games (“Game(s)”) and win vouchers based on game scores.
2. TNG Digital Sdn. Bhd. (“TNGD”) acknowledges and agrees that Apple has no obligation to provide any maintenance and support services for Games Hub and/or any of the Games(s) therein.
3. TNGD further acknowledges that Apple will not be responsible for addressing any claims that users or any other third party may have in relation to Game Hub and/or any of the Games(s) therein.
Eligibility and Participation
1. Users are required to have a registered TNG eWallet account to participate and play the Game(s) (“User(s)”).
2. Each Game(s) session requires a certain amount of GOrewards points to participate. The amount of GOrewards points to play will be stated at each
3. Game before the Users enter the game. Points will be deducted when user enters the game.
4. Each User(s) may participate and play Game(s) multiple times, subject to having sufficient GOrewards points for participation.
Prizes
1. a. Prizes may include:
  1. Reload PINs (denominations ranging from RM0.10 to RM999.00).
  2. Cashback vouchers and/or;
  3. Discount vouchers.
    1. TNGD reserves the right to determine the type of prizes to be awarded to the Winners.
    2. The prizes are subject to their own specific terms and conditions. For further information, please refer to the detailed terms and conditions of the prizes.
    3. Prizes won are non-transferable, and non-exchangeable for cash or any items.
    4. Prizes won are fully sponsored by TNGD & affiliated partners.
User(s)’ Conduct
1. Users shall use Games Hub in compliance with all applicable laws and regulations.
2. Users shall not:
  1. use Games Hub and/or any of the Game(s) therein for any unlawful, illegal and/or fraudulent purpose; and
  2. run Games Hub and/or any of the Game(s) therein with any other programs, software, automated bots, and/or any other tools that may interfere with any aspect of Games Hub, the Game(s) and/or the mobile application interface thereof.
  3. Users shall be responsible for all information that is submitted, transmitted and/or otherwise made available when using Games Hub and/or participating in any of the Game(s) therein, whether to TNGD and/or other third parties.
Downtime and Upgrades
1. TNGD (whether directly or through its appointed sub-contractors, assignees and/or service providers) may continuously update, change, and/or develop
2. Games Hub and/or any of the Game(s) offered therein. TNGD may also remove, change and/or alter any of the Game(s) offered on Games Hub.
3. Games Hub and its related services, including any of the Game(s) offered therein may experience downtime and lack of availability due to maintenance, updates and/or any other reasons.
4. Games Hub may also be subjected to unplanned, unforeseeable and/or unexpected maintenance, interruptions, disruptions or unavailability for any other reasons beyond TNGD’s control such as any force majeure events or as a result of third party’s actions and/or omissions. TNGD shall not be liable for any damages or losses whatsoever, caused by reasons beyond its control.
General
1. TNGD shall be entitled to take any form of action against any user who abuses any of the Game(s) and/or Games Hub, including but is not limited to, any suspicious activities, or any attempts to circumvent any of the Terms and Conditions herein.
2. TNGD reserves the right, at its sole and absolute discretion to withhold, claim and/or forfeit any benefits and/or Prizes if the users are found to have been in breached of any of the Terms and Conditions herein.
3. TNGD shall not be liable for any indirect, incidental, or consequential loss or damage of any kind, including but not limited to damages for lost advantage, lost savings, loss of data or loss of profit, any alleged unauthorised transactions, disruptions, errors, defects or unavailability of the

Game(s), whether or not the user has been advised of the possibility of such damages or whether foreseeable or otherwise and regardless of the form of action whether in contract, warranty, strict liability, tort (including negligence of any kind), breach of statutory duty, or other forms of action.
5. Notwithstanding anything to the contrary herein, TNGD shall not be liable for (i) any malfunction in any hardware, software, server, or network that is not controlled, provided, and/or maintained by TNGD; (ii) any disruption, error, defects, loss of game sessions, unsaved game sessions, and/or unavailability of the Game(s), the Game Hub and/or its related services/features due to lapse or malfunction in internet connection; (iii) any physical injury, accident, damages, or losses as may be suffered by the users in the usage and/or operation of the Game(s) and/or Game Hub, (v) any refusal by TNGD to make available the Prizes, Game Hub and/or any of the Game(s) to the User(s) for reasons, in TNGD’s judgment, that is in violation to the terms and conditions herein; or (vi) unforeseen events that prevents proper performance despite the reasonable precautions having been taken by TNGD.

7. TNGD’s decision shall be final. Any correspondence pertaining to the decision made by TNGD will not be entertained.
8. TNGD reserves the right to vary, amend and/or delete these Terms and Conditions and/or each individual Game(s) terms and conditions at its sole discretion by giving five (5) days prior notice of such variation, amendment and/or deletion, and the user shall be bound to such changes. Such notice shall be updated herein from time to time, and it is the user’s responsibilities to keep updated on such changes.
9. This Terms and Conditions shall be governed by the laws of Malaysia and any dispute arising out of or in connection with the campaign shall be referred to the exclusive jurisdiction of Malaysian Courts.
