GOrewards Loyalty Program- Points

1.      Membership

1.1   You are required to complete the onboarding process to participate in the GOrewards Loyalty Program – Points (“Program”).You will be deemed to have read, understood, and accepted these Terms and Conditions by participating in the Program.

1.2   As a member of the Program, you are eligible for points upon successful transactions made using Touch ‘n Go eWallet (“TNG eWallet”), subject to the transaction categories specified in the FAQ. You are also eligible for points redemption subject to the Terms and Conditions.

1.3   Members of the Program are entitled to participate in campaigns and receive other rewards and privileges from time to time, subject to the respective Terms and Conditions.

1.4   Program membership and points are non-transferable.

1.5   Membership is completely free. Only TNG eWallet users who have successfully joined the Program will be eligible for points. TNGD at our sole discretion can choose to remove members from the Program should they be found to be in breach of the Terms and Conditions as stated herein.

2.      Points

2.1   Reward one (1) point for every RM1 spent. A minimum spend of RM1 is required to earn points. Members may check their points balance and transaction history on the GOrewards page, which serves as conclusive evidence. Example:

·        RM5.90 = 5 Points

·        RM1.11 = 1 Point

·        RM0.90 = 0 Points

2.2   Partner bonus points will only be issued for payment made with TNG eWallet. Payment made with TNG eWallet Visa Card is only entitled to standard baseline points.

2.3   Points may be redeemed according to the redemption catalogue provided on the TNG eWallet, subject to compliance with the redemption procedures. TNGD Digital Sdn Bhd (“TNGD”) reserves the right to make the final decision on the product catalogue to be redeemed without prior notice. The points balance will be recalculated upon confirmation of redemption.

2.4   Points expire six (6) months from the month in which they were earned, and unused points will automatically be forfeited. Members can track expiring points on the GOrewards page. For example:

·        Points earned on 1 January 2023 will expire on 30 June 2023

·        Points earned on 15 January 2023 will expire on 30 June 2023

·        Points earned on 31 January 2023 will expire on 30 June 2023

2.5   Points are non-exchangeable and non-convertible to cash. Forfeited or unredeemed points cannot be reinstated, and there will be no extension of the validity period for unused points.

2.6   TNGD reserves the right to adjust or cancel points and take any necessary action with or without notice to members if there is a reasonable suspicion of fraudulent, erroneous, abusive, or dishonest point earning or redemption activity.

2.7   Once points are redeemed, they cannot be cancelled, exchanged for cash, or returned. TNGD bears no responsibility for resolving disputes over redeemed products or services received as rewards. Members must settle such disputes with the relevant service establishment or product supplier. Reward redemption is subject to additional terms and conditions of the company, supplier, and/or third party. TNGD makes no, and hereby waives and disclaims, any representations or warranties regarding the vouchers, services and/or physical products redeemed, any services contemplated hereby, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement, and/or any implied warranties arising out of course of dealing. Without limiting the generality of the foregoing, TNGD specifically disclaims any representation or warranty regarding any economic or other benefit that you might obtain through your redemption or usage of the Voucher.

2.8   TNGD bears no responsibility, warranty, or liability for any failure or delay of any goods, services, or rewards supplied by a supplier or third party.

2.9   TNGD disclaims responsibility for any delay, accrual, or accumulation of Points. TNGD reserves the right to deduct all or part of the points for refund or cancellation transactions as it deems fit.

3.      Termination of membership

3.1   Your membership will be automatically terminated in the event your TNG eWallet is terminated.

3.2   Prior to terminating you TNG eWallet, you have the option to redeem all remaining points, as any unredeemed points balance will be forfeited automatically upon cancellation or termination of your membership.

3.3   Points cannot be accumulated, carried forward, or transferred, even in the event of the Program membership reinstatement.

3.3.1 TNGD reserves the right, at our absolute and sole discretion and with or without prior notice, to suspend or terminate your membership for any reason we deem fit.

4.      General

4.1   TNGD shall be entitled to withhold any benefits under the services rendered, with or without prior notice to the users if the users are found to have been in breach of any TNGD’s User Terms and Conditions, which can be found athttps://www.touchngo.com.my/assets/pdf/user-tnc.pdf

4.2   By participating in this Program, you agree to be bound by these Terms and Conditions and any other terms and conditions governing the use of facilities, benefits, or services associated with your membership, which may be amended or varied from time to time.

4.3   TNGD may, at its sole and absolute discretion, settle disputes as it deems appropriate. TNGD’s decision shall be final and conclusive. TNGD shall not be liable for any breach of duty of care owed to a Member by any of TNGD’s employees, staff, or authorized personnel, or for any indirect, consequential, or economic losses, loss of profits, loss of opportunity, or punitive damages of any kind.

4.4   TNGD reserves the right, at any time, to vary, modify, replace, substitute, or terminate the Program or any rewards, benefits, features, or privileges under the Program or withdraw Points from use, with or without prior notification to Members, and without being liable in any way to Members.

4.5   TNGD reserves the right at its absolute discretion, from time to time, to vary, add to, delete or otherwise amend these Terms and Conditions or any part thereof by giving you twenty-one (21) days prior notice of such changes, additions or deletions. Your continued use of the Program after the effective date of any variation, addition, deletion or amendments to these Terms and Conditions shall constitute your unconditional acceptance of such variation, addition, deletion or amendments.

4.6   TNGD may, in its sole discretion, serve you notice under these Terms and Conditions by posting such notice on the TNGD’s website, GOrewards page, or any other online or other medium, which TNGD may introduce from time to time.

4.7   Subject to applicable laws, TNGD may, at any time and at its sole discretion:

(a)    Change the method of calculating earned Points, modify the method of earning Points, and change the validity period of points;

(b)   Change or withdraw Members benefits and/ or modify the eligibility and qualifications for earning points;

(c)    Withhold and cease points awarded; and/or

(d)   Terminate the Program;

with or without prior notice to the Member and at its sole discretion.

5. Disclosure of information to third-party supplier for the purpose of delivery or services render

5.1   For the purpose of delivery or services rendered, TNGD may disclose your information to third party suppliers.

5.2   You acknowledge that once your information is shared with the third-party suppliers, the third-party suppliers shall have sole and full control of the copy of your information disclosed and you are required to contact the relevant third-party suppliers for any matters in relation to it.

5.3   TNGD hereby is released from all obligations and responsibilities towards the copy of information which is shared with the third-party suppliers. For clarification, TNGD shall at all times ensure that your personal data and information in the control of TNGD shall be processed in accordance to TNGD Group’s privacy notice and the applicable laws.
